The 9th Multaqa Ruwwad afternoon session featured two speakers, they are Sheikh Abdul Fattah Moro from Tunisia and young Indian cleric Sheikh Yusuf An-Nadwiy, son of Shaykh Salman al-Husainiy al-Nadwiy. Session moderated by Dr. Abdul Hamid ben Salim is entitled Supporting factors the Liberation of Masjid Al-Aqsa. Sheikh Abdul Fattah gave the prologue that the weakness of Muslims internally became an important step for the Zionists to establish its existence. Therefore, it is being urgent and unnecessary to be postponed is to reinforce this ummah through roles that can be unite them in strategic decision making at the international level as well as massive mobilization out of the issues and humanitarian problems faced by the colonized nation. This requires a massive, coordinated movement through the media to make Palestine a priority for humanitarian issue. Meanwhile, Sheikh Yusuf an-Nadwiy sees from a different point of view, the strength of the Palestinian people to the present time in the face of humanity’s terror, physical pressure, illegal occupation, deprivation and oppression, a sign that the Zionist project is facing a major problem. The media’s buzz is a pseudo, comfort and prosperity and splendor built on seized land and illegal occupation is a mirage. Therefore, the obligation of Muslims outside Palestine is to continue to provide unending support to end this colonialism and restore the rights of the native Palestinian people.
At the same time, Hai’ah Ulama’ Filistin (the Association of the Palestinian Ulema) held a conference which was attended by representatives of scholars from various countries. The main discussion of this conference is against the Normalization of Politics against the Zionist Government. Interestingly, this study is discussed from the side of sharia by presenting two experts in the field. Dr. Washfy Asyur Abou Zeid, an expert on maqâshid shari’ah (goals and aims of shari’a) and Dr. Muhammad Hammam, an expert on hadith and ushul fiqh (jurisprudence) from Jordan.
In his presentation, Dr. Washfy Asyur sees from the maqâshid shari’ah side. He gives a prologue of field conditions when there’s distortion of reality, a friend becomes an enemy opponent and an opponent becomes a familiar friend. Thus, normalization with the occupiers, especially politically very contrary to maqâshid shari’ah. In the main theory of maqâshid which keep religion, in fact the Zionist occupiers desecrate the mosque, the symbol of religion, endangering the unity of the people who continue to bring into conflict and become the main cause of maintaining religion well.
Ideologically, normalization also endangers faith, for changing the direction of loyalty. As a consequence, there were some scholars and thinkers who opposed the political normalization being arrested and criminalized. Dr. Washfy cited the statement of al-Izz bin Abdissalam who proposed a rule about mafsadah resulting from an act will affect the law of that action. In fact, if it really happens or is strongly possible to happen but it remains to be done then it can put the culprit into the big sinner. For example, it can lead to the loss of many souls, the occurrence of great injustice. This normalization leads to greater of disadvantages. Prevention of this danger of mafsadah becomes an obligation that must be done by this people.
Dr. Muhammad Yusri, who acted as moderator, gave a second chance to Dr. Muhammad Hammam. The special theme that he studied was about peace negotiations and agreements with the colonists from the point of fiqh muwâzanah. He delivered seven principles of fiqh muwâzanah. Among other things, the main rules about maqashid shariah and dharuriyat al-khamsah that includes the stairs of kuliyat rules. Then he passed on the second principle concerning the preparation of priorities and the consequent loss of an important thing. For example, if things are lost (abandoned) like the pillars of prayer, even if only one will result in the cancellation of prayer, the effect is great. This is different from things other than pillars, such as compulsory or sunnah, it will not result in the cancellation of prayer. He also conveyed some rules about the principle of benefit, which is give priority to the general than the peculiarly. Also, the benefit that occurs or strong predictions take precedence over the foreseeable or doubtful.
In a dialogue session the participants consisted of scholars from various countries provide comments and responses. Along with the athan maghrib then the afternoon session is ended.
The evening session is held after dinner, discuss about Reality and Danger of Normalization. Moderated by Dr. Amal Khalifah, this session presents Dr. Abdurrazaq al-Muqry, Ustadz Abdul Hayy Yusuf and Sheikh Murad al-Ya’qubiy.
